Trademark Registration

A trademark can include signs, logos, words, images, figures, graphics, packaging styles, colors, and more.

You will be able to use the trademark registered symbol ® as soon as the registration process is completed. The Ministry of Commerce and Industry has a dedicated branch to manage Intellectual Property (IP), which is responsible to process trademark registration requests.

Trademarks registered in Panama are valid for 10 years from the date of application. This period can be renewed within the year prior to its expiration, and there is a grace period of 6 additional months to renew with a surcharge. It is important to keep track of these dates to avoid the loss of rights over the trademark.

Panama trademark registration requirements

  • Power of attorney granted to a lawyer by the trademark owner, when required.
  • Sworn affidavit about trademark use.
  • Trademark description.
  • If the mark has a special design, is an image, logo or 3D, two copies of it must be attached to the application (in physical or digital format, depending on the presentation channel).
  • If the trademark is in the process of registration in another country and has priority, the priority document of the country where the trademark application is filed, authenticated by a notary public, and legalized by the Panamanian Consulate of said country or by means of the Apostille, will be required.
  • Corresponding government fees.
