Law No. 238 of September 15, 2021, extends the scope of the Maternity legal exception to the father, granting vacations in the event of the death of the mother.
According to the Constitution of the Republic of Panama, together with the labor code, the working mother will have labor immobility for a term of 1 year (she cannot be fired) except in special cases provided for in the Law.
The scope of said Maternity legal exception is extended to the father in the following cases:
- Death of the mother during childbirth.
- Death of the mother within 12 months after delivery.
- In case the mother is pregnant within 12 months after giving birth
she does not have a formal job.
If the mother dies, the legal exception must be extended until the end of 1 year from the birth, added to that, the father will have the right to 15 days of vacation, granted after complying with the time of mourning established by the regulations. company internal.
If the mother does not have a formal job, the father cannot be fired during her pregnancy and after childbirth, at least for a term of 1 year.
