The Family Code of Panama shows us a list of 10 grounds for requesting a unilateral divorce.
What are the causes of divorce?
- The attack of one of the spouses against the life of the other, or of their children, daughters, step-children or step-daughters;
- Cruel physical or mental treatment if with it domestic peace and tranquility becomes impossible;
- The extramarital sexual relationship;
- The proposal of one of the spouses to prostitute the other;
- Conatus of the husband or wife to corrupt or prostitute their children, daughters, step-children or step-daughters, or cohabitation in their corruption or prostitution;
- Absolute abandonment on the part of the husband of his duties as husband or father, and on the part of the woman, of his duties as wife or mother, if at least six (6) at the time of filing the divorce petition months, counted from the day in which the cause originated, except in the case of the abandonment of a pregnant woman, in which case the term will be three (3) months;
- The habitual and unjustified use of drugs or psychotropic substances;
- The habitual drunkenness;
- The de facto separation for more than two (2) years, even if they live under the same roof;
- The mutual consent of the spouses provided that the following requirements are met:
- That the spouses are of legal age;
- That the marriage is at least two years old;
- That the parties ratify their divorce request after two months from the filing of the divorce petition and before six (6) months of the aforementioned filing.
